Terms of Service
These terms govern your use of PulseWatch's hosted service at app.pulsewatchai.com (the "Service"), operated by Paulo Jardim, based in Ireland ("we", "us"). By creating an account or using a trial, you agree to these terms. If you're agreeing on behalf of a company, you're confirming you have authority to do so.
1. The Service
PulseWatch monitors infrastructure you connect to it (via an agent you install on your own servers) and provides incident detection, alerting, and optional automated remediation ("self-healing"). A free, unlimited self-hosted version is also available separately under its own README — these Terms apply specifically to the hosted service we operate for you, not to software you run yourself.
2. Trials and accounts
- Hosted trials are provided free for an evaluation period; we may change or end the trial program at any time.
- You're responsible for keeping your account credentials confidential and for all activity under your account.
- You must provide accurate information when signing up.
- We may suspend or terminate an account that violates these terms, is used for unlawful purposes, or where a trial has expired without conversion to a paid plan.
3. Acceptable use
You agree not to use the Service to:
- Attempt to access another customer's workspace or data without authorization
- Probe, scan, or test the vulnerability of the Service without our written permission
- Interfere with or disrupt the Service or servers/networks connected to it
- Upload or transmit anything unlawful, or that infringes someone else's rights
- Use the self-healing/remote-command features against infrastructure you don't own or have explicit authorization to manage
4. Your data and content
You retain ownership of the data your agents send us and any content you create in the Service (incident notes, rule configurations, etc.). You're responsible for having the right to send us any data your monitored infrastructure generates, including ensuring you're not sending us special-category personal data you haven't told us about. See our Privacy Policy for how we handle it, and Section 6 of that policy for our role as a data processor for your monitoring data.
5. Availability and support
We aim to keep the Service available and reliable, but we don't currently offer a formal uptime SLA for trial or free accounts. Paid plans may include specific support/availability commitments agreed separately. The Service is provided without warranty of any kind, express or implied, including fitness for a particular purpose — you should not rely on it as your sole means of detecting critical infrastructure failures without your own independent safeguards.
6. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data, revenue, or business, even if advised of the possibility. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim (or, for free trial use, to a nominal amount, since no fees were paid).
7. Termination
You can stop using the Service and request deletion of your account at any time by emailing [email protected]. We may suspend or terminate access for violation of these terms, non-payment (for paid plans), or trial expiry. On termination, we'll delete your workspace data within a reasonable period, subject to any retention we're legally required to keep.
8. Changes
We may update these terms from time to time; we'll update the date above and, for material changes, notify active account holders by email.
9. Governing law
These terms are governed by the laws of Ireland, without regard to conflict-of-law principles.
